eBay Hit with Lawsuit Over Coin Listing Policy

Seems like they're lawsuits popping up like daisies for eBay. Unfortunately, many of the actions filed against eBay are tucked away deep on the net.  Unless you have all access to public records and/or you're very specific in your Google search, it's unlikely you'll come across eBay lawsuits unless you stumble upon them. A lawsuit was filed Jan. 10, 2008 against eBay, the American Numismatic Association (ANA) and the Professional Numismatists Guild (PNG) for defamation and unfair and deceptive trade practices.

The suit was filed in United States District Court for the Middle District of Florida by National Numismatic Certification, LLC (NNC), ASA Accugrade, Inc (ACG), PCI Coin Grading, Inc (PCI), Treasure Gallery, Inc., Sovereign Entities Grading Service, Inc.(SEGS) and Centsles, Inc

The various grading companies are "brand names" for services which there is no fixed, enforcable standard. Indeed, seldom will two experts agree on the grade of a coin. The question becomes whether eBay has the right to ban certain BRANDS of the same product, especially since some of the APPROVED brands are ebay partners. Since ebay is "just a venue," market demand should determine the acceptability of certain brands of products.
